1. Introduction

Welcome to The Photography Network ("TPN", "we", "our", or "us").

TPN is an online platform designed to connect photographers, models, creatives, agencies, and other industry professionals while promoting professionalism, transparency, accountability, safety, and trust within the photography industry.

By accessing or using TPN, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.

If you do not agree with these Terms, you must not access or use the platform.

2. Eligibility

To create an account or use TPN, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into legally binding agreements.
• Provide accurate, complete, and truthful information.
• Maintain the confidentiality and security of your account credentials.

TPN reserves the right to suspend, restrict, or terminate accounts that contain false, misleading, inaccurate, or fraudulent information.

3. Nature of the Platform

TPN provides an online platform that enables members to:

• Create professional profiles.
• Connect with photographers, models, creatives, and industry professionals.
• Share experiences and reviews.
• Participate in community discussions.
• Access resources, opportunities, and industry-related information.

TPN does not employ, manage, supervise, endorse, certify, guarantee, or otherwise control the conduct of its members.

Any collaboration, booking, agreement, contract, payment arrangement, or professional relationship entered into between members is solely the responsibility of those members.

TPN acts solely as a platform provider and is not a party to any agreement formed between users.

4. User Responsibilities

Users agree to conduct themselves professionally and respectfully, communicate honestly and accurately, respect personal boundaries and consent, honour agreed commitments wherever reasonably possible, and comply with all applicable laws and regulations.

Users must not harass, intimidate, threaten, or abuse other members; engage in discriminatory conduct; share false, misleading, defamatory, or malicious information; impersonate another individual or organisation; use the platform for unlawful purposes; attempt to manipulate ratings, reviews, rankings, or platform functionality; or engage in conduct that may place another member at risk.

5. Ratings and Reviews

TPN may provide functionality allowing members to rate and review one another.

Users acknowledge and agree that reviews should be based on genuine first-hand experiences, reviews represent the opinion of the author only, TPN does not guarantee the accuracy, completeness, or reliability of reviews, and TPN is not responsible for opinions expressed by users.

TPN reserves the right to moderate, remove, or investigate reviews and restrict or suspend accounts involved in review manipulation.

Reviews that are considered defamatory, abusive, retaliatory, misleading, malicious, or otherwise inconsistent with TPN standards may be removed without notice.

6. Safety and Consent

TPN supports safe, respectful, and professional creative environments.

All members acknowledge that consent must be informed, voluntary, and ongoing; consent may be withdrawn at any time; no individual is obligated to participate in any activity, concept, pose, wardrobe choice, implied photography, artistic nude photography, or creative direction that makes them uncomfortable; and personal boundaries must be respected at all times.

TPN encourages members to prioritise their own safety and wellbeing during all interactions and collaborations.

7. User Generated Content

Users retain ownership of content uploaded to TPN.

By uploading content, users grant TPN a worldwide, non-exclusive, royalty-free licence to display, store, reproduce, promote, and distribute content as necessary for operation of the platform.

Users warrant that they own the content or have appropriate permission to use it, the content does not infringe any third-party rights, and the content complies with applicable laws and regulations.

8. Nudity and Explicit Content

TPN is a professional networking, reputation, and community platform. While TPN recognises that some members may participate in genres including implied, artistic nude, boudoir, or other adult-oriented photography, the platform itself is not intended to host, display, distribute, or promote nude or sexually explicit content.

Users must not upload, publish, share, transmit, distribute, or otherwise make available through TPN: full frontal nudity, visible genitalia, visible female nipples, explicit sexual content, pornographic material, content depicting sexual acts, fetish content, content intended primarily for sexual gratification, or sexually graphic or exploitative imagery.

This restriction applies regardless of whether the content was created professionally, artistically, commercially, or with the consent of all participants.

Members may discuss photographic genres involving nudity in a professional or educational context. However, images containing nudity or sexually explicit content must not be uploaded to or displayed on TPN.

TPN reserves the right to remove such content immediately and may suspend or terminate accounts that repeatedly breach this policy.

9. Prohibited Content

Users must not upload, publish, share, distribute, or transmit content that is unlawful, defamatory, threatening, abusive, or harassing, promotes violence, violates privacy rights, infringes intellectual property rights, contains malicious software or harmful code, is intended to deceive, manipulate, or mislead users, or encourages illegal activity.

TPN reserves the right to remove prohibited content without notice.

10. Reporting Concerns

Members may report conduct, content, or behaviour that they believe breaches these Terms, Community Standards, or applicable laws.

TPN may review reports, request additional information, restrict content, suspend accounts, terminate accounts, or refer matters to appropriate authorities where required.

TPN reserves the right to investigate reports and complaints but does not determine criminal guilt, innocence, or legal liability.

Submission of a report does not guarantee any specific outcome or action.

11. Account Suspension and Termination

TPN may suspend, restrict, or terminate accounts where it reasonably believes a user has breached these Terms, breached Community Standards, engaged in unsafe conduct, provided false information, manipulated platform systems, or exposed other members to harm or risk.

TPN is not liable for any loss arising from account suspension, restriction, or termination.

12. Intellectual Property

All TPN branding, logos, designs, software, databases, platform functionality, content, and intellectual property remain the property of TPN or its licensors.

Users must not reproduce platform content without permission, copy platform functionality, reverse engineer platform systems, or use TPN branding for commercial purposes without written consent.

13. Disclaimer

TPN provides the platform on an "as is" and "as available" basis.

To the maximum extent permitted by law, TPN makes no warranties or representations regarding user conduct, profile accuracy, review accuracy, availability of opportunities, suitability of members, or outcomes of collaborations.

Users assume all risks associated with their use of the platform and interactions with other members.

14. Limitation of Liability

To the maximum extent permitted by law, TPN, its directors, officers, employees, contractors, volunteers, affiliates, and representatives shall not be liable for personal injury, emotional distress, property damage, financial loss, reputational harm, loss of business, loss of opportunity, or indirect or consequential damages arising from the use of the platform or interactions between members.

Where liability cannot be excluded by law, TPN's liability shall be limited to the maximum extent permitted under applicable legislation.

15. Indemnity

Users agree to indemnify and hold harmless TPN, its directors, officers, employees, contractors, volunteers, affiliates, and representatives from any claims, liabilities, damages, losses, costs, or expenses arising from breach of these Terms, breach of applicable laws, user-generated content, conduct toward other members, or misuse of the platform.

16. Privacy

TPN collects, stores, and processes personal information in accordance with its Privacy Policy.

By using TPN, users consent to such collection, storage, and use of information as described in the Privacy Policy.

17. Changes to These Terms

TPN reserves the right to amend these Terms at any time.

Updated versions will be published on the platform.

Continued use of TPN following publication of updated Terms constitutes acceptance of those changes.

18. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
