Misconduct Reports & Investigations Policy

1. Purpose

The Photography Network (TPN) is committed to fostering a safe, respectful, professional, and accountable environment for photographers, models, creatives, agencies, and industry professionals.

This Policy outlines how TPN receives, reviews, assesses, and responds to reports of misconduct involving members of the platform.

This Policy applies to:

  • All TPN members.
  • Conduct occurring on the TPN platform.
  • Conduct occurring during photography shoots.
  • Industry events and workshops.
  • Collaborations arranged through TPN.
  • Conduct that may reasonably impact the safety, reputation, or wellbeing of TPN members.

TPN may consider conduct occurring outside the platform where it is relevant to community safety.

3. What Can Be Reported

Members may submit reports regarding conduct including, but not limited to:

Professional Conduct Concerns

  • Repeated no-shows.
  • Last-minute cancellations without reasonable explanation.
  • Misrepresentation.
  • Unprofessional behaviour.
  • Harassment.
  • Intimidation.

Safety Concerns

  • Boundary violations.
  • Coercion.
  • Predatory behaviour.
  • Unsafe shoot environments.
  • Inappropriate communication.
  • Repeated unwanted contact.

Consent-Related Concerns

  • Pressure to participate in concepts beyond agreed limits.
  • Failure to respect withdrawn consent.
  • Misuse of images.
  • Unauthorised publication of content.

Serious Allegations

  • Sexual misconduct.
  • Assault.
  • Threatening behaviour.
  • Criminal conduct.

Where criminal behaviour is alleged, TPN may encourage the reporting party to contact relevant authorities.

4. Submitting a Report

Reports should include as much information as reasonably possible, including:

  • Names of parties involved.
  • Dates and locations.
  • Description of events.
  • Screenshots, messages, emails, contracts, or supporting evidence where available.
  • Names of witnesses, if applicable.

TPN may be unable to investigate reports that contain insufficient information.

5. Confidentiality

TPN will make reasonable efforts to handle reports confidentially.

  • Disclosure is required by law.
  • Disclosure is necessary to assess a report.
  • Disclosure is necessary to protect community safety.
  • Disclosure is required to respond fairly to allegations.

However, confidentiality cannot be guaranteed where:

Members submitting reports acknowledge that aspects of their report may need to be shared with relevant parties during assessment.

6. Assessment Process

Upon receiving a report, TPN may:

  • Review submitted information.
  • Request additional evidence.
  • Seek clarification from involved parties.
  • Consider previous reports or relevant platform history.
  • Assess whether immediate safety concerns exist.

TPN is not obligated to investigate every report and may determine that no further action is required.

7. Fairness and Natural Justice

TPN aims to treat all members fairly.

Where appropriate, a member who is the subject of a report may be given an opportunity to respond before a decision is made.

The existence of a report does not automatically indicate wrongdoing.

TPN will consider available information and exercise reasonable judgement when determining appropriate actions.

8. Interim Measures

Where TPN reasonably believes immediate action may be necessary to protect community members, TPN may implement temporary measures while a report is being assessed. These measures may include:

  • Temporary account restrictions.
  • Suspension of messaging functions.
  • Suspension of review privileges.
  • Temporary account suspension.
  • Removal of content.

Interim measures do not represent a finding of wrongdoing.

9. Outcomes

Following assessment, TPN may determine that:

  • No action is required.
  • Education or guidance is appropriate.
  • A warning should be issued.
  • Content should be removed.
  • Reviews should be removed.
  • Account features should be restricted.
  • Temporary suspension is appropriate.
  • Permanent removal from the platform is appropriate.

Outcomes are determined at TPN's sole discretion.

10. False, Malicious, or Misleading Reports

TPN encourages honest reporting. Members must not knowingly submit:

  • False allegations.
  • Misleading information.
  • Fabricated evidence.
  • Retaliatory complaints.

Where TPN reasonably believes a report was intentionally false or malicious, action may be taken against the reporting member.

11. Criminal Matters

TPN is not a law enforcement agency, court, tribunal, or regulatory body.

TPN does not determine criminal guilt, innocence, or legal liability.

  • Encourage members to contact police or relevant authorities.
  • Cooperate with lawful requests from authorities where required.
  • Take platform-based actions where community safety concerns exist.

Where reports involve allegations of criminal conduct, TPN may:

Any action taken by TPN is independent of any criminal or civil proceedings.

12. Appeals and Review

Members may request that TPN review a decision where:

  • Significant new information becomes available.
  • Material facts were unavailable during the original assessment.

The decision to conduct a review remains at TPN's discretion.

13. Limitation of Responsibility

Members acknowledge that:

  • TPN cannot independently verify all allegations.
  • TPN cannot guarantee the accuracy of information provided by members.
  • TPN cannot guarantee member safety.
  • TPN cannot prevent all misconduct.

TPN's role is limited to administering its platform and making community management decisions based on information available at the time.

14. Image Content Policy

TPN is a professional platform. All portfolio images must comply with the following content standards.

Permitted Content

  • Artistic, implied, and editorial nude photography.
  • Censored nude imagery where explicit content is not visible.
  • Lingerie, swimwear, and body paint photography.
  • Bare bottoms where no explicit content is visible.

Prohibited Content

  • Visible nipples.
  • Visible genitalia.
  • Sexually explicit imagery.
  • Any content involving minors in an inappropriate context.
  • Content that violates Australian law.

TPN reserves the right to remove any image that violates this policy without notice. Repeated violations may result in account suspension or permanent removal from the platform.

15. Policy Changes

TPN reserves the right to amend this Policy at any time.

Updated versions will be published on the platform and take effect upon publication.
